Funded by a grant from the U.S. Department of Justice (DOJ), the Office of Justice Program (OJP), the Office of Juvenile Justice and Crime Prevention (OJJDP). “The legal basis for ICPA`s appeal to the Constitutional Court was flawed in many ways. September 2022 – that the clicks business structure violates the Pharmacy Act and its regulations, and that if clicks are allowed to continue this way, they violate individuals` constitutional right to access affordable health services. Clicks Group Limited is a healthcare retail company. Through retail brands such as Clicks, General Nutrition Corporation (GNC), The Body Shop, Claire`s and United Pharmaceutical Distributors (UPD), the company has more than 841 stores in Southern Africa. Clicks is a pharmacy, health and beauty retailer with over 782 stores and 621 pharmacies. It also operates Clicks Baby Store and offers brands such as Clicks Made4Baby, Chicco and Maxi Cosy. Its CNG is the health and wellness retailer. GNC offers a range of vitamin, mineral and herbal supplements, sports nutrition and slimming products. The Body Shop sells natural beauty products in 59 standalone stores. Claire`s is the specialty retailer of fashionable jewelry and accessories for young women and girls.

UPD is a full-service pharmaceutical wholesaler, providing retail pharmacies, private hospitals, prescription doctors and retail health stores. It also provides mass distribution services to pharmaceutical manufacturers. CAPI believes that click pharmacies actively promote their own brands and that click pharmacists have incentives to promote their Unicorn brand: their performance reviews would require that a certain percentage of sales be private label sales. “This could put some of their pharmacists in a difficult position to recommend a drug they feel is best for the patient, or an alternative unicorn private label to ensure their performance rating is favorable.” Ms Wrigglesworth added: “The safety, quality and efficacy of medicines manufactured by Unicorn are authorised by SAHPRA. Medicinal products are registered medicinal products manufactured in establishments approved by approved manufacturers and distributed by approved bodies. There can be no doubt about the safety, quality or efficacy of the medicinal products sold or an indication that patient safety is threatened. The prices charged for Unicorn`s medicines are low and within the reference prices of medical systems. There is a lot of competition between pharmaceutical manufacturers that ensures that generic prices are competitive. So what about New Clicks` ownership of Unicorn Pharmaceuticals shares and what the layman might consider an (indirect) financial interest in Clicks Retailers? Counsel for Clicks points out that section 22A of the Pharmacy Act only allows the Minister to prescribe “who is authorized to own a pharmacy.” He does not have the right to prescribe who might have a financial interest in a pharmacy. If rule 6(d) were interpreted as regulating not only who owns a pharmacy, but also who might have a financial interest in it, the regulation would be invalid. Rachel Wrigglesworth, Clicks` director of healthcare, comments: Next, they start with an impact assessment of Regulation 6(d), which states: “Anyone can […] own or have an economic interest in a Community pharmacy, provided that such a person …

or shareholder is not [at the same time] the owner or holder of a direct or indirect economic interest in a producing pharmacy. An organization that represents more than a thousand independent pharmacy owners wants the Constitutional Court to close the 650 Clicks-owned pharmacies across the country. A case initiated by the Independent Community Pharmacy Association (ICPA) against the Clicks group six years ago is expected to go to the Constitutional Court one last time in September. The case has already been argued in two hearings by the Department of Health and Human Services (Clicks won both), the Western Cape High Court (ICPA won), and then before a five-judge bench of the Supreme Court of Appeal (where Clicks won 4-1). Clicks Counsel concluded: “The highlight of the CAPI case is that its holding companies violated the regulations. Unicorn and the retailers themselves did not. And Rule 2 states that it is subject to Rule 7(a), but there is no such regulation. In their court filings, Clicks` lawyers first note that while ICPA`s original complaint was expressly an application to revoke the pharmacy licenses of Unicorn and Clicks Retailers for their alleged violation of Rule 6(d), ICPA had made a turning point in its appeal argument: it now asserted that: that their holding companies, Clicks Investments, New Clicks and Clicks Group had infringed the regulation. Nevertheless, he still wanted the licenses of Unicorn and Clicks Retailers revoked. “CAPI is not fighting for patients` rights. It seeks to use litigation to promote the narrow commercial interests of its members. Two facts show it very clearly: do you live in one of our locations? If so, contact your state`s partner. The 6.

In May 2016, ICPA filed a formal complaint with the Ministry of Health alleging that Unicorn Pharmaceuticals, a pharmaceutical manufacturing company of the Clicks Group, and Clicks Retailers, a group company that owns 650 retail pharmacies, are violating a published regulation within the meaning of the Pharmacy Act. The pharmacy owns or has, perhaps also has no interest in this. in a producing pharmacy. “It follows that anyone can own a producing pharmacy or have an economic interest in it. The attack on Unicorn`s license was therefore completely wrong. In any case, according to Clicks` lawyers, the regulation does not allow the minister or his deputy, the Health Branch, to revoke the license. Section 22(d) of the Pharmacy Act only provides that the DG, in consultation with Council, may close a pharmacy that is operated in contravention of the Act. [The difference in results between closing a pharmacy and revoking its license may seem insignificant to the average reader, but for lawyers, these distinctions can decide or break a case.] We understand that all influences, whether positive or negative, will affect our lives.

Our goal at CLICKS is to transmit and support positive influences and enriching experiences in the lives of young people. Our program and activities focus on law, sport, health and social justice. We are leaders whose mission is to create leaders. The owner/shareholder of the manufacturer Unicorn is New Clicks, while the owner/shareholder of Clicks Retailers Clicks Investments is another company. • This position will be located at our headquarters in Woodstock and will report to the Chief Legal Officer and co.
